These Terms and Conditions (“Terms”) govern your access to and use of our website www.hunterswarehousesa.co.za (the “Website”) and all services, products, and content provided through it. The Website is operated by Hunters Warehouse, a company registered in the Republic of South Africa with registration number 2007/100190/23 and VAT number 4180305304, located at 183 Ian Street, Cnr. Ian & Boshoff Strs, La Hoff, Klerksdorp, 2571 (“we”, “us”, “our”).
By accessing, browsing, or purchasing from the Website, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree, do not use the Website or place orders.
1. Use of the Website
•  You must be 18 years or older and a resident of South Africa to use this Website for purchases.
•  You agree to use the Website only for lawful purposes and in compliance with all applicable South African laws, including the Consumer Protection Act 68 of 2008 (CPA), Protection of Personal Information Act 4 of 2013 (POPIA), and the Firearms Control Act 60 of 2000 (FCA) as amended.
•  You may not misuse the Website (e.g., hacking, transmitting viruses, or infringing intellectual property).
2. Products and Restricted / Regulated Goods
We sell outdoor and sporting goods including (but not limited to) hunting and fishing equipment, clothing, camping gear, archery equipment, self-defence items, firearms, ammunition, and related accessories.
Firearms and Ammunition (Restricted Goods):
•  All sales of firearms and ammunition are strictly subject to the Firearms Control Act 60 of 2000 and related regulations.
•  Firearms will only be sold to individuals holding a valid South African firearm licence (or appropriate permit) issued by the South African Police Service (SAPS), or to licensed dealers/gunsmiths.
•  Ammunition will only be sold to persons holding a valid licence for a firearm capable of discharging that ammunition, or to authorised permit holders (limited generally to 200 rounds per firearm unless exceptions apply under the FCA).
•  You warrant and undertake that you are legally authorised to possess and purchase the restricted goods you order.
•  We reserve the right to request proof of valid licence(s), permits, identity documents, and any other documentation before processing or releasing any restricted item.
•  Failure to provide satisfactory proof within [e.g., 7 days] may result in order cancellation and refund (less any costs incurred).
•  Firearms will be transferred only to the licensed purchaser or a nominated licensed dealer/gunsmith for handover in compliance with FCA requirements.
•  Ammunition, primers, propellants, and certain restricted items may only be collected in-store or shipped via authorised couriers (e.g., RAM Couriers or similar licensed for restricted goods).
•  Storage of Restricted Goods After Purchase: See Section 5 for details on varying storage fees that may apply if restricted goods are not collected promptly after purchase and legal compliance.
Non-Restricted Goods:
•  Camping, clothing, fishing, archery (non-firearm components), self-defence gear (non-regulated), etc., are subject to standard sale terms.
We reserve the right to refuse or cancel any order (including partially fulfilled orders) if we reasonably believe it violates any law or our policies.
3. Orders and Payment
•  All orders are subject to acceptance by us. We may refuse or cancel orders for any reason, including errors in pricing, stock unavailability, or suspected fraud.
•  Prices are in South African Rand (ZAR) and include VAT where applicable. We reserve the right to correct pricing errors.
•  Payment must be made in full via the methods displayed on the Website.
•  Reservation of Ownership / Retention of Title: Notwithstanding delivery, collection, or any other transfer of possession, Hunters Warehouse retains full ownership and title to all products (including restricted goods) until the customer has paid any and all outstanding amounts in full, including the purchase price, shipping costs, storage fees (if applicable), and any other charges related to the transaction. Ownership and title will only pass to you upon full payment and (for restricted goods) full compliance with legal transfer requirements under the FCA. Until such time, you hold the goods as bailee only and must not sell, pledge, encumber, or otherwise deal with them without our prior written consent.
•  Risk of loss or damage passes to you upon delivery or handover to the courier / nominated dealer, even while title remains with us.
4. Shipping and Delivery
•  We ship within South Africa only (no international shipping for restricted goods).
•  Non-restricted goods may ship via standard couriers.
•  Restricted goods (firearms, ammunition, etc.) ship only via licensed/authorised firearms couriers or must be collected in-store/from a licensed dealer.
•  Delivery times are estimates only. We are not liable for delays caused by couriers, customs, SAPS processes, or force majeure.
•  Shipping costs are added at checkout and are non-refundable unless we cancel the order.
•  For restricted goods not collected promptly, varying storage fees may apply as detailed in Section 5.
5. Returns, Refunds, and Exchanges
•  Non-restricted goods: Returns accepted within 14 days of receipt if unused, in original packaging, and with proof of purchase. You bear return shipping costs unless the item is faulty/damaged.
•  Restricted goods (firearms, ammunition, etc.): No returns, exchanges, or refunds except where required by law (e.g., defective goods under warranty). All sales are final due to legal restrictions.
•  Faulty/defective products are subject to manufacturer warranties. Contact us for assistance.
•  No refunds on special-order or custom items unless faulty.
Storage Fees for Restricted Goods After Purchase:
•  We provide secure storage for purchased restricted goods (e.g., firearms, ammunition, and similar regulated items) pending your collection or handover, in compliance with FCA safe-keeping requirements.
•  Storage fees vary depending on the type of item (e.g., firearm vs. ammunition), duration of storage, and any applicable grace period.
•  No storage fees are charged for the first 6 months from the date of purchase (to allow for licence processing or permit finalisation—exact period confirmed at time of purchase).
•  After the 6-month grace period expires, varying monthly storage fees will apply until the goods are collected (e.g., per firearm, per batch of ammunition, or similar). Current indicative rates are available on request or displayed at our premises/checkout for restricted items.
•  You agree to pay any accrued storage fees in full before collection or release of the goods.
•  We reserve the right to adjust storage fee rates with reasonable notice (e.g., via Website update or direct communication).
•  Failure to collect goods or pay storage fees may result in further action in accordance with law (including potential retention rights or disposal processes where permitted).
•  Storage fees are non-refundable and separate from purchase price or other costs.
6. Warranties and Liability
•  We warrant that products are of merchantable quality at dispatch, subject to manufacturer specifications.
•  To the fullest extent permitted by law, we disclaim all other warranties (express or implied).
•  We are not liable for misuse of products (especially firearms/ammunition), improper storage, or failure to comply with safety laws.
•  Our total liability shall not exceed the purchase price of the product giving rise to the claim.
7. Intellectual Property
All content on the Website (text, images, logos) is our property or licensed to us. You may not copy, reproduce, or use it without permission.
8. Privacy and Personal Information
Your personal information is processed in accordance with our Privacy Policy and POPIA. By using the Website, you consent to such processing.
9. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in Klerksdorp, North West Province.
10. Changes to Terms
We may update these Terms at any time. Continued use of the Website constitutes acceptance of changes. Check this page periodically.
